Legal Update

Roberto Montesino, attorney at Whiteford, Taylor & Preston (NPCA's legal counsel), detailed a few of the most important recent amendments to the D.C. Condominium Act, which have implications for NPCA Association operations:
  • Meeting notice: Board meetings (but for closed, executive sessions) have to be open to observation by all unit owners in good standing. The agenda of board meetings must be available for review by unit owners prior to the meeting.
  • Association books and records: The Association's financial books and records must be made available, upon written request and five days notice, to unit owners (with certain exceptions for confidential documents).
  • Common area damage originating from a unit: If damage to building common elements originates from a unit, the owner of that unit will be responsible for the Association’s insurance deductible up to $5,000; this amount may be assessed against the owner’s unit.
  • Liens and legal fees: The statute specifies that liens against units may be for legal fees accrued by the Association, in addition to delinquent condo fees and late fees.
  • Association powers: So long as the Board of Directors acts within its duties, powers, and discretion as outlined by the Association's governing documents, the "business judgment rule" will be the standard applied to the Board's actions (should owner and/or legal challenges arise).
  • Important - unit insurance: Unit owners are now required to obtain homeowner’s insurance coverage with dwelling (whether residential or commercial) property coverage at a minimum of $10,000 and condominium owner personal liability insurance coverage at a minimum of $300,000. The Board of Directors will request proof of coverage from owners on an annual basis.

Property Management Update

The Board of Directors created a Welcome Packet for new owners. The Welcome Packet is a quick reference guide to the most common Bylaws and House Rules topics, plus answers to owner FAQs.

Board of Directors Election

  • Owners Mark Fisher, Eric Horton, and Nathan Joyce were elected to the Board of Directors for two-year terms. 
  • Outgoing Board members include Max Perkins, Laura Stellato, and Laurie Kaufman (who will, however, serve as Committee Chair for the Phase 2 redesign until completion). 
  • Incumbent members Adam Beebe and Julia Whitelock have one year remaining on their terms.

Phase 2 of Interior Redesign (Floors 2-7)

The proposed "Phase 2" of the interior redesign-- bringing design elements of the recently re-done lobby up to floors two through seven-- was approved (22 votes in favor; 2 opposed; 1 abstention).
